Terms of Service — Dirt Bike Buddy
Effective date: July 5, 2026
These Terms of Service ("Terms") are a binding agreement between you and AMTM Tech Inc ("Dirt Bike Buddy," "we," "us," or "our") governing your use of the Dirt Bike Buddy iOS application, the dirtbikebuddy.app website, and the live-share and invite pages we host (together, the "Service").
By creating an account or using the Service you agree to these Terms, to our Privacy Policy, and to the in-app Liability Waiver & Release you accept at signup, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
PLEASE READ SECTIONS 3–6 CAREFULLY. THEY CONTAIN SAFETY DISCLAIMERS, AN ASSUMPTION OF RISK, A RELEASE OF LIABILITY, AND LIMITS ON OUR LIABILITY.
1. Eligibility and your account
- You must be 18 years of age or older. The Service is not for minors, even with supervision.
- You must provide accurate information and keep your account secure. You are responsible for everything done under your account. One account per person; you may not transfer your account or impersonate anyone.
- We may suspend or terminate accounts that violate these Terms (Section 9).
2. What the Service is — and is not
Dirt Bike Buddy is a tool for finding riding partners, planning rides, recording rides, and sharing your location with people you choose. It is not:
- an emergency service (Section 4);
- a vetting or background-check service (Section 3);
- a guarantee of anyone's safety, skill, identity, equipment, or conduct — including trail conditions, weather forecasts, or map data.
3. Meeting other riders is at your own risk
The Service connects strangers. We do not run background checks, verify identities, or vouch for any rider. Sticker/vehicle verification badges indicate only that a user submitted a photo of ORV registration — they are not identity verification. Ratings reflect other users' opinions, not our endorsement. Use the same judgment you would meeting any stranger from the internet: tell someone where you are going, meet in public trailheads, and leave any situation that feels wrong. You are solely responsible for your interactions with other users, on and off the trail.
4. Safety features are best-effort — NOT an emergency service
Off-road riding areas frequently have no cell coverage. Every safety feature in the Service — live location sharing, the group map, solo-ride watcher emails, overdue check-in alerts, and SOS — depends entirely on your device having battery, GPS signal, and a data connection, and on third-party networks we do not control. Accordingly:
- The Service never contacts 911 or any emergency service, under any circumstances. SOS notifies your riding group and/or your chosen ride watchers only. In an emergency, call 911 yourself.
- Location data, alerts, and emails may be delayed, inaccurate, or never delivered. A stale position or a silent app does not mean a rider is safe, and an "overdue" alert does not mean a rider is in danger.
- Overdue alerts fire only from the "back by" time you set yourself, plus a grace period. If you do not set one, no overdue alert exists.
- Ride watchers are people you choose. We do not monitor rides, and no human at Dirt Bike Buddy watches your location or responds to alerts.
- Safety features are a supplement to — never a substitute for — a charged phone, a riding plan shared with someone at home, appropriate gear, riding within your ability, and common sense. Consider a satellite communicator for remote riding; this app is not one.
You agree not to rely on the Service as your means of summoning help.
5. Riding is dangerous: assumption of risk and release
Operating off-road vehicles is inherently dangerous and can result in property damage, serious injury, paralysis, or death, from causes including terrain, obstacles, weather, equipment failure, and the conduct of other riders. You voluntarily assume all risks of riding, including rides you discover, join, organize, record, or share through the Service.
To the fullest extent permitted by applicable law, you release and hold harmless AMTM Tech Inc, its owners, officers, employees, and agents, and you release other users of the Service, from any and all claims, demands, damages, and causes of action — whether based in negligence, contract, or otherwise — arising out of or related to (a) your riding, (b) rides discovered, organized, joined, or recorded through the Service, (c) your interactions with other users, and (d) the performance or non-performance of any safety feature. This release mirrors and supplements the in-app Liability Waiver & Release you accepted at signup. It does not apply where prohibited by law, and nothing in these Terms waives rights that cannot be waived.
6. Disclaimer of warranties; limitation of liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY SAFETY FEATURE WILL FUNCTION IN ANY GIVEN SITUATION, THAT MAP OR TRAIL DATA IS ACCURATE OR CURRENT, OR THAT WEATHER INFORMATION IS RELIABLE.
TO THE FULLEST EXTENT PERMITTED BY LAW: (a) IN NO EVENT WILL AMTM TECH INC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM RIDING OR FROM RELIANCE ON THE SERVICE; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
Some jurisdictions do not allow certain exclusions or limits; in those jurisdictions our liability is limited to the maximum extent permitted.
7. Follow the law and land rules
You agree to comply with all applicable laws and land-use rules wherever you ride, including Michigan Department of Natural Resources ORV regulations (licensing and trail stickers, helmet and safety requirements, trail and route designations, sound limits, and closures). See https://www.michigan.gov/dnr/things-to-do/orv-riding. Trail data shown in the app comes from public sources, may be outdated, and never overrides posted signage or current conditions. You are responsible for confirming that riding is lawful where and when you ride.
8. Your conduct and content
Conduct. You agree not to: harass, threaten, or endanger others; misuse safety features (including false SOS); stalk or monitor anyone without consent; add someone as a ride watcher without their permission; post others' personal information; scrape or reverse-engineer the Service; attempt unauthorized access; use the Service for commercial solicitation; or interfere with its operation.
Your content. You retain ownership of content you post (rides, messages, photos, Tracks). You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content solely to operate and improve the Service, ending when you delete the content or your account (except as retained per our Privacy Policy). Do not post anything unlawful, infringing, or that is not yours to share.
Objectionable content and abusive users are not tolerated. We provide in-app tools to block any user and report any content or user. We review reports and act on violations — typically within 24 hours for reported content — including removing content and ejecting offending users. We may remove any content or restrict any account at our discretion, with or without notice.
Feedback you send us may be used without restriction or compensation.
9. Termination
You may stop using the Service and delete your account at any time (Settings → Delete my account). We may suspend or terminate your access at any time for violation of these Terms, risk to other users, or legal necessity. Sections 5, 6, 8 (license, for retained records), and 10–12 survive termination.
10. Apple App Store terms
These Terms are between you and AMTM Tech Inc, not Apple Inc. Apple has no obligation to furnish maintenance or support, has no warranty obligation (any warranty claim within the scope of law is ours), and is not responsible for addressing any claims relating to the app, including product liability, regulatory compliance, or IP claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in an embargoed country and are not on any U.S. government prohibited-party list, and you agree to comply with applicable third-party terms (for example, your wireless data agreement) when using the Service.
11. Governing law and disputes
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws rules. Before filing any claim, you agree to contact us at legal@dirtbikebuddy.app and give us 30 days to try to resolve it informally. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Michigan, and you consent to their jurisdiction. To the extent permitted by law, both parties waive any right to a jury trial and agree that disputes will be brought only on an individual basis — not as a plaintiff or class member in any class, consolidated, or representative proceeding. Either party may instead pursue an individual claim in small-claims court.
12. General
- Changes: we may update these Terms; we will post the new version here, update the effective date, and for material changes notify you in the app or by email. Continued use after the effective date is acceptance.
- Fees: the Service is currently free. If we ever introduce paid features, we will present terms and pricing before you are charged.
- Severability: if any provision is unenforceable, the rest remains in effect, and the provision will be enforced to the maximum extent permitted.
- No waiver: our failure to enforce a provision is not a waiver.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure: we are not liable for failures caused by events beyond our reasonable control (including network and carrier outages — see Section 4).
- Entire agreement: these Terms, the Privacy Policy, and the in-app Liability Waiver & Release are the entire agreement between you and us regarding the Service.
